Court dismisses appeal by rapist

BANGALORE: The High Court on Tuesday dismissed an appeal by a native of Bangalore, who is serving term in prison, for having raped a minor girl.

The petitioner, Nagesh, a resident of Shettihalli in Jalahalli, said the Kudur police of Bangalore Rural district had arrested him for the rape of a minor girl on February 7, 2006.

Guilty

The Fast Track Court (FTC)-2, Bangalore Rural District, had, on December 1, 2006, found him guilty of rape and sentenced him to 10 years rigorous imprisonment and had imposed a fine of Rs. 5,000.

Nagesh had appealed against the FTC verdict before the court.

Opposing the petition, the State said Nagesh had lured the girl by promising her to get her some fish.

The girl, who was playing near a temple, refused to accompany Nagesh, who assaulted her and forced her to go with him.

Nagesh then took the girl to Bande Gudda in Kudur and raped her. Nagesh was booked under Sections 323, 506 and 376 Indian Penal Code (IPC).

Justice V. Jagannathan upheld the lower court order and dismissed the appeal.
