“Demolition drive can’t be stopped”

Modifications required in the new building by-laws, says Subhash Arya

NEW DELHI: The Leader of the House in the Municipal Corporation of Delhi, Subhash Arya, has said it will be impossible to stop demolition of fourth and fifth floors greater than 15 metres in height unless the Floor Area Ratio (FAR) is increased by the Central Government.

In a statement, Mr. Arya said: “As per the new building by-laws, an FAR of 350 is allowed for plots having an area up to 175 sq. m. with fourth floor up to height of 15 metres. In case the FAR is not increased, the fourth and fifth floors of residential houses constructed prior to December 31, 2006, with 100 per cent coverage will have to be demolished. Since the house owners have covered 100 per cent area at ground and first floors, the only way to save such houses from demolition is to remove the limit of 350 FAR in the new building by-laws and a one-time amnesty scheme be provided to all such residences.” Mr. Arya said the Master Plan for Delhi-2021 had allowed sub-division of industrial plots. “If this provision is allowed in residential areas as well, the houses which were divided after partition in joint families can also be saved from demolition.” The senior BJP leader said he had requested Union Urban Development Minister Jaipal Reddy for a meeting to apprise him of the modifications required in the new building by-laws. “If required, an Ordinance in this regard will be promulgated ,” he added.
