CBI told to submit narco test result in Abhaya case


‘Produce it before magistrate court in sealed cover’

Plea to subject other suspects to test refused


Kochi: The Kerala High Court on Friday directed the CBI to produce in a sealed cover the result of the narco-analysis test conducted on the suspects in the Sister Abhaya case before the Ernakulam Chief Judicial Magistrate court. The CBI was asked to submit a copy of the same before the High Court in two weeks.

Justice V. Ramkumar said the report would remain with the magistrate court in a sealed cover without any of the parties having any right of disclosure till the appropriate stage. No person was entitled to move any court other than the High Court for knowing the contents of the report at the appropriate stage unless the report becomes part of the record in the supplementary final report to be filed by the CBI.

It should be disclosed only in case the narco-analysis test report provided for a reasonable basis for suspecting the complicity of any person. The court said that the CBI had the freedom to proceed further and conduct investigation in that direction and bring to book the guilty.

The directives were passed on a petition filed by Jomon Puthenpurackal, a human rights activist seeking a direction for producing the narco-analysis test result before the magistrate court.

The magistrate court had directed the CBI to file periodic reports on the progress of the investigation before the court.

Passing orders on Mr. Jomon’s petition, the Judge, refused another plea for a directive to the CBI to subject other suspects to narco-analysis test.
