Kochi: The Ernakulam Judicial First Class Magistrate-I, Tommy Varghese, on Monday dismissed the petition filed by the Navy seeking custody of its personnel who were arrested on charge of attacking the Harbour police station. The petition, seeking custody of the Navy personnel for court-martialling them, was filed by Commanding Officer Cmde. S.K. Jha under Section 475 of the Criminal Procedure Code. Under this Section, the magistrate can hand over persons liable to be court-martialled to commanding officers. The court rejected the petition on the ground that it was premature.
