NEW DELHI: The Delhi High Court on Thursday ordered an inquiry into an alleged mischievous attempt by a jail superintendent of Tihar Central Jail here who wrote to the Deputy Commissioner of Police (Third Battalion, Delhi Armed Police) that Uphaar cinema fire tragedy convict Radhey Krishna Sharma was “very critical” whereas the medical report said he was only suffering from hypertension. Bluff, says CourtConvict Radha Krishna Sharma had annexed the letter to his bail application and sought bail on this ground. However, the Court called his bluff when the Medical Superintendent of the jail in his report informed it that only the convict’s blood pressure had shot up and he was treated for it in a government hospital here. Ordering the inquiry, Justice H.R. Malhotra of the Court observed that it seemed there was an attempt at “mischief” by presenting a wrong medical report to the Court by the convict to get bail. Mr. Justice Malhotra observed that he was inclined to grant bail to the convict after seeing the Jail Superintendent’s letter to the DCP. The Medical Superintendent had submitted the medical report to the Court following a direction by it following filing of the bail application. Panel to probe matterThe Court ordered the Medical Superintendent of Ram Manohar Lohia Hospital here to set up a three-member committee and probe how the Jail Superintendent certified that the convict was critical while the jail’s Medical Superintendent’s report certified him to be normal. A trial court here had sentenced the convict to seven years’ rigorous imprisonment last year in the case. He is at present serving the punishment in Tihar Jail.
