HYDERABAD: A Division Bench of the A.P. High Court comprising Chief Justice A. R. Dave and Justice Ramesh Ranganathan on Thursday restrained the State government from passing final orders on applications made pursuant to the latest Building Regularisation Scheme (BRS) for two weeks. It was passing an interim order on a writ petition filed by K.H.V. Prasad of Habsiguda. The Bench made it clear that the authorities could receive applications and process them, but orders should not be passed for a period of 15 days. The petitioner challenged the constitutional validity of the ordinances issued by the State government. He said that he purchased a flat in an apartment complex wherein, the permission was given for four floors and the builder constructed two additional floors illegally. He said the common facilities and the undivided portion of the land had been fixed for four floors and creating rights for other purchasers of two other floors would be in violation of the A.P. Apartments Act. The Bench directed the respondents to file their counter affidavits and adjourned the matter.
