Blueline operators move court over impounded buses

NEW DELHI: The Capital’s Blueline bus operators moved the Delhi High Court on Thursday seeking modification of an order in which the Court had last year asked the bus owners to deposit Rs.1 lakh as fine for release of their impounded buses if they were involved in fatal accidents and Rs. 50,000 for those that had caused injuries.
Taking their revision petition on record, a Division Bench of the Court comprising Justice Mukul Mudgal and Justice Reva Khetrapal issued notice to the Delhi Government, returnable on February 8.
Bus operators’ counsel Puja Aganpal submitted that since their vehicles were insured by insurance companies for any liabilities for the damages likely to be caused to third party, they could not be compelled to bear them.
Third party liabilities should be recovered from the insurance companies, she submitted, contending that the insurance companies that had taken the responsibility to bear the third party liabilities should be directed to fulfil their commitments.
She urged the Court to make the insurers parties to the matter pending in the Court.
The High Court had last year taken into its own hands the power to release impounded buses involved in accidents.
The Court had said that metropolitan magistrates would forward cases of impounded buses involved in accidents to the High Court which would then decide whether or not to release them.
Earlier metropolitan magistrates were empowered to release these buses on “superdari”.
