Hyderabad: A Division Bench of the Andhra Pradesh High Court comprising Justice T. Meena Kumari and Justice G. Rohini on Monday stayed all further proceedings against Ramoji Rao, Hindu Undivided Family (HUF), by the Income Tax Department. These interim orders were given on a writ petition filed by Mr. Ramoji Rao representing the assessee, Hindu Undivided Family (HUF). The petitioner alleged that the officers had issued notices asking for information and records regarding the deposits made in four assessment years between 2001 and 2005. All the deposits were to be received through cheque or draft if the amounts exceeded Rs. 20,000. The department said that there was reason not to believe that all the deposits were taken as per rule. The petitioner contended that the notice disclosed a predetermined mind of the officer who indicated the liability for penalty. The officer had asked for information for all the five years. The petitioner said that some pressure was being used in this regard. The Bench adjourned the matter to February 18 and stayed further proceedings.
