Witness remained absent from the earlier hearing citing medical reasons NEW DELHI: A court here has issued a bailable warrant against a witness who had claimed in a television interview that Sunil Kulkarni, eyewitness in the BMW hit-and-run case, was not in the Capital when the incident took place in 1999. Additional Sessions Judge Vinod Kumar issued the warrant against Gauri Shankar Tiwari, a resident of Mumbai, after he failed to appear for the second time before the court. The warrant is returnable on February 15. Tiwari had claimed in an interview with a Hindi news television channel that Kulkarni was not in Delhi on January10, 1999, when the incident took place. Kulkarni had told the court that he was at the spot when the BMW, allegedly being driven by prime accused Sanjeev Nanda, mowed down six persons, including three policemen, on Lodhi Road in the early hours of January 10. The defence had listed Tiwari as one of its witnesses and the court had allowed him to appear before it for recording his statement. However, Tiwari had remained absent from the earlier hearing citing medical reasons. ProsecutionAt present, the prosecution is cross-examining the defence witnesses in the case. After the completion of the cross-examination, final arguments will begin in the case that has been going on for nine years.
