Ordnance Factory should notify vacancies: HC

MADURAI: The Central Ordnance Factory, under the Union Defence Ministry, in Tiruchi, cannot fill up vacancies only from among its former apprentices without inviting candidates registered with the employment exchanges concerned, the Madras High Court has ruled.

Allowing a writ appeal filed before the Madurai Bench, a Division Bench said that the factory should advertise the vacancies in newspapers besides calling for a seniority list from the employment exchange and then give preference to its apprentices if the candidates from both streams were equally qualified.

The Bench said that the procedure laid down by it should be followed in all future appointments.

However, the appointments made so far shall stand unchanged and they need not be disturbed, it clarified.

The appellant, M. Sabarinathan, claimed that more than 500 vacancies were filled up without any notification.

The appeal was filed against a single judge’s refusal to interfere with the appointment mechanism followed by the ordnance factory.

He had held that the factory was free to appoint labourers from the waiting list of its former apprentices who were trained for the job with a guarantee of employment.

On the other hand, the Division Bench relied upon the Supreme Court decisions in U.P. State Road Transport Corporation Vs. U.P. Parivahan Nigam Shishukhs Berozgar Sangh (1995) and Excise Superintendent, Malkapatnam Vs. K.B.N. Visweswara Rao (1996) to arrive at a different conclusion than that of the single judge.
