THIRUVANANTHAPURAM: Thiruvananthapuram Bar Association president C.K. Sitaram said the President of India can sanction a High Court Bench in any region in consultation with the Governor and the Chief Justice of the High Court concerned. Quoting the relevant sections of the State Reorganisation Act of 1956, Mr. Sitaram said legal experts should not construe “consultation” as granting permission or striking a favourable position. The President of India is free to establish a High Court Bench in any State, irrespective of the opinion of the Governor or the Chief Justice. He said the Union government’s opinion (as articulated by Union Law and Justice Minister H.R. Bhardwaj) that the Kerala Chief Justice’s sanction was required for establishing a High Court Bench in the capital city should be correctedMr. Sitaram urged the State government to exert pressure on the Centre for allowing a High Court Bench. The Federation of Residents’ Association (Thiruvananthapuram) plans to launch a massive campaign for the establishment of a High Court Bench. Its members and office-bearers would meet at Jawahar Balabhavan on Sunday to chart out the future course of action.
