CHENNAI: A compensation of Rs.3 lakh, awarded to the kin of a custodial death victim, was enhanced to Rs.5 lakh by a Division Bench of the Madras High Court on Wednesday. The Bench, comprising Justice Elipe Dharma Rao and Justice S.R. Singharavelu, revising the quantum fixed by a single judge, said the family of the victim was reeling under financial crunch owing to the sudden death of the head of the family. Natarajan Chettiar, a pawn broker, was picked up by the Tiruvannamalai district police in September 1993. His body was found in the Thachambattu reserve forest the next day. His family members maintained that he died due to police excesses and that the body was thrown into the forests by the police. The authorities contended that he was let off with an instruction to come back with more information on the stolen jewellery he had purchased. Factual matrixIn view of the pendency of a criminal case, a single judge of the court refrained from entering into the factual matrix of the case and awarded Rs.3 lakh to the family members. The kin of the deceased preferred an appeal, stating that the quantum of compensation was inadequate to the family, which comprised six children besides Rajammal, wife of the deceased.
