Court allows petition by study centres derecognised by varsity

Staff Reporter

BANGALORE: The Karnataka High Court has quashed a notification issued by Bangalore University derecognising some study centres in Bangalore and has directed the varsity to pass fresh and considered orders after affording the centres a chance of hearing.

No valid grounds

Justice Ashok B. Hinchigeri passed the orders on petitions by study centres that had challenged a decision by the university to derecognise them.

Allowing their petitions, the court said the university had not given valid and sufficient grounds in withdrawing the affiliation to these centres which are offering courses to students under the Department of Distance Education.

Allowed

In what could be a major relief to the visually challenged, Justice Nagmohan Das directed the State Government to accept applications by the visually challenged for the posts of teachers in Government schools.

The judge passed the order on petitions by Dasarathi of Bangalore and a resident of Mysore, who claimed that their applications had not been considered by the Education Department though there was an order of a Division Bench of the High Court directing the State to reserve one per cent of posts of teachers to the visually challenged. Justice Nagmohan Das passed the interim order and adjourned further hearing on the case.

Dismissed

Justice N. Ananda on Thursday quashed the summons issued to former Chief Minister and BJP leader B.S. Yeddyuruppa in a defamation case and remanded the case back to the Belgaum court.

A Belgaum court had issued summons to Mr. Yeddyurappa following a compliant against him by Congress leader Shankar Munavalli.

Mr. Munavalli claimed that Mr. Yeddyurappa had defamed him by making certain allegations.

Framing charges

A Division Bench comprising Justice V.G. Sabhait and Justice Narayanaswmay on Thursday directed the BDA Commissioner to be present in court on March 13 for framing of charges.

The court passed the order on a petition by Srinivas, a resident of Bangalore, who had challenged the illegal act of the Ministry of Communications Housing Society in allotting civic amenity sites in Sahakaranagar on Bellary Road to some individuals and organisations.

Though the society had handed over certain percentage of land in the layout to the BDA, the organisation had not taken any step to protect it. The agency also did not do anything when it noticed large-scale violations.
