BANGALORE: The Central Administrative Tribunal (CAT) on Friday ordered issue of notices to the Union and Karnataka governments on an application by Administrator of the Bruhat Bangalore Mahanagara Palike and Chairman of Bangalore Development Authority Dilip Rau who has challenged the selection of Sudhakar Rao as Chief Secretary of Karnataka. A Division Bench of the CAT, comprising Shantappa and Gautam Ray, posted the case to March 6 for further hearing. In his application, Mr. Dilip Rau said the State had, on Thursday, shifted Chief Secretary P.B. Mahishi to the post of Chairman of the Karnataka Power Corporation limited and named Mr. Sudhakar Rao, Additional Chief Secretary and Development Commissioner, as his successor. Urging the CAT to quash the appointment, Mr. Dilip Rau said it was illegal and unconstitutional. Mr. Rau’s advocate, Subramanya Jois, submitted before the CAT that Mr. Sudhakar Rao had superseded several senior IAS officers and that the Government had not given any reason or passed any order for effecting the transfer or for making the new appointment. The superseded officers are Mr. Mahishi, Additional Chief Secretary to the State Neerja Rajkumar, Mr. Rau, and Additional Chief Secretary and Chairperson of the Krishna Bhagya Jala Nigam Limited Usha Ganesh. Mr. Rau said the act of the Government was in violation of Article 14 and Article 16 of the Constitution.
