Notice to State on law panel proposals

Kochi: A Division Bench of the Kerala High Court on Monday issued notices to the State government and other respondents on writ petitions seeking a direction for implementing the Law Commission recommendations for setting up a separate investigating agency and establishment of a Directorate of Public Prosecution at the district and state levels.

The petitions were filed by R. Gokul Prasad of Palakkad. According to him, the Law Commission of India, in its 154th report in 1996, had made these recommendations. It was for conducting a proper, efficient and speedy investigation of crimes that the commission recommended a special investigating agency. However, no action had been taken by the Central and State governments. As per one of the recommendations, the public prosecution directorate at should be headed by an upright person for proper conduct of cases. It was different from the present system of prosecution where public prosecutors were made to report to the District Collector. The Law Commission recommended that prosecutors should be appointed from the panel selected by the Sessions Judge. In the present administration of criminal justice, there was no machinery to supervise or control the prosecution department, the petitioner said.

Suspension quashed

Justice A.K. Basheer has quashed the Kannur University Syndicate decision to place University Registrar K.M. Abdur Rasheed under suspension in connection with allegations of irregularities in land acquisition for the university. It observed that a perusal of the files undoubtedly showed that the decision of the Syndicate was not warranted in the facts and circumstances of the case.
