CAT upholds penalty on two Delhi policemen

New Delhi: The Central Administrative Tribunal (CAT) has declined to set aside the penalty imposed on two Delhi Police personnel accused of beating a citizen and extorting money.

A bench of the Tribunal consisting of Vice-Chairman L K Joshi and Member Justice Meera Chhibber said, “The law is now well settled that in disciplinary matters, court cannot re-appreciate the evidence”.

“Court can interfere only if it is demonstrated that enquiry was not conducted as per the procedure or it is a case of no evidence or the findings recorded are perverse, said the bench upholding the penalty of withholding of three future increments imposed on Assistant Sub-Inspector (ASI) Satpal and Constable Ashok Kumar”.

The Tribunal referred to Supreme Court rulings and said that it was not the function of the Administrative Tribunal to review the decisions and reach different finding than that of the disciplinary authority.

Petitioners were suspended from service after it was alleged that they had on November 22, 2004 picked up one Chhannu Khan from his shop in the Nangloi area of south-west Delhi in a case of quarrel with another resident of the locality and took him to the police station.

They had then allegedly extorted Rs 15,000 from him by threatening to implicate him in a case of kidnapping. - PTI
