NEW DELHI: The Delhi High Court has set aside a single-judge Bench judgment dismissing a direction by the Delhi State Industrial and Infrastructure Development Corporation to industrial plot allottees in Narela to make payments for the plots at revised rates. The single-judge Bench last year had quashed the DSIIDC direction on a bunch of petitions by the allottees challenging the fiat to make the payments at the revised rate of Rs.7,776 per square metre. Earlier, the rate was fixed Rs.5,400 per sq. m. A Division Bench headed by Chief Justice M.K. Sharma set aside the single-judge Bench order on an appeal by the DSIIDC. The industrialists have been allotted plots in the Narela Industrial Area following their relocation on a Supreme Court direction. The Supreme Court had in 1996 directed the Delhi Government to re-locate industries from non-conforming zones of the Capital as they were causing environmental pollution. The Division Bench in its judgment said the single-judge Bench verdict was wrong as the DSIIDC did not enjoy the power to fix the rate for the plots. It was only an implementing authority, the Bench said, adding that it was the Department of Industries of the Delhi Government that had fixed the rate. Therefore, the Corporation could not be faulted for revision of the rate, the Bench said.
