High Court hears petitions on encounters

HYDERABAD: Cases pertaining to armed conflicts where citizens die cannot be routinely closed at the instance of the investigating officer, said Bojja Tarakam, while appearing for several civil rights groups, before a five-judge High Court Bench on Monday.
The AP Civil Liberties Committee (APCLC) had sought prosecution of police offices who participated in ‘encounters’ against Maoists.
After two Division Benches had expressed divergent views, the issue was referred to a three-judge Bench. The three judges felt there could be no blanket order that a murder case had to be registered after an armed clash and the police had to prove it was in self-defence.
K.G. Kannabiran, appearing for the PUCL, said the issue involved was of larger importance to democracy.
