Rape accused acquitted

NEW DELHI: A court here has acquitted a man accused of criminally assaulting a girl after kidnapping her two and a half years ago. Additional Sessions Judge R.K. Yadav acquitted accused Sunder, who had been arrested in May 2005, a month after he allegedly kidnapped the victim.
The court said the victim did not tell the truth because she wanted to project herself as a virtuous girl. It added that the facts given by the victims, when assessed through normal human behaviour, showed that she had given colour to her version.
During cross-examination, the victim also did not support the police theory on the sequence of events leading to the arrest of the accused. While the police maintained that the accused had tried to flee the spot along with the victim on his motorcycle, the victim denied this.
In her statement, the victim had said she was going for tuitions in the early hours of April 4, 2005, when the accused kidnapped her and took her to his native place in Uttar Pradesh.
The court said it was unbelievable that any tutor would take classes in the early hours of the morning.
