HYDERABAD: A Division Bench of the High Court comprising B.Prakash Rao and C.Y.Somayajulu on Tuesday imposed costs on Ramoji Rao, chairman of Eenadu group, while permitting him to withdraw writ petitions filed by him against an Income Tax officer. The IT Department had issued notices to Ramoji Rao and Ramoji Rao HUF to furnish information regarding the mode of payments to depositors. The law permits these payments only through cheques or drafts if the amount exceeds Rs. 20,000 and the officer alleged that the deposits were received violating the rule and sought details. Mr. Ramoji Rao filed five writ petitions challenging the five notices and alleged that the officer had pre-judged the case and contended that the office was under the influence of ruling party leaders. Initially another Division Bench granted stay of further action. When the case came up on Tuesday, the Bench pointed out that when serious allegations are made against an officer he had to be made party respondent. Counsel for the petitioners sought permission to file petitions impleading the officer. The Bench took exception to this and said that such a plea cannot be made now. The counsel sought permission to withdraw the writ petitions with liberty to file fresh case.
