Directive to remove encroachments

CHENNAI: The Madras High Court has directed the Municipal Administration and Water Supply Department and the CMWSSB to remove all encroachers from lands in three survey numbers, Kalvaithurai Salai, Aspiran Garden, Kilpauk, within six months.

Passing orders on a writ petition, the First Bench comprising Chief Justice A.P Shah and Justice Prabha Sridevan said it was needless to say that hutment dwellers, who were in a position to produce proof of their occupation of any portion of the said lands prior to the cut-off date, June 30, 1984, would be entitled to alternative accommodation as per a government order dated November 3, 1988.

In its writ petition, the Federation of K. K. Nagar Residents Welfare Associations submitted that the lands in the three survey numbers belonged to the CMWSSB and the main pipes which supply water to the city passed through them.

The lands had been encroached upon by several families. They had put up temporary shelters and were causing nuisance.

Due to the untidy atmosphere, there was every possibility of drinking water getting contaminated.
