Man awarded compensation for medical negligence

VISAKHAPATNAM: The Visakhapatnam District Consumer Forum-I has awarded compensation and costs to a consumer who was a victim of medical negligence.

According to the case record, M. Venkata Krishna of Ravikamatham in Visakhapatnam district had a the problem of skin on the foremost part of his reproductive organ.

He contacted proprietor of Sri Sitharama Nursing Home-cum-Scanning and Endoscopic Centre in Chodavaram K. Sundar Ramam, who performed circumcision on August 1, 2004. But even after the surgery, the consumer faced the problem.

Complications

In fact, there were complications such as swelling, pain, and itching and the wound did not heal.

When he consulted the surgeon again, he advised him to undergo a second surgery.

The consumer then consulted a specialist in urology, general surgeon and Assistant Professor at Andhra Medical College Bala Rambabu, who performed the surgery to relieve the consumer of the pain.

Legal notice

The consumer got issued a legal notice to Dr. Sundar Ramam and the later filed a complaint (872/2005) in the Forum for refund of Rs.15,000, which he incurred towards cost of second surgery along with the cost of the first surgery, including medicines and transport, which amounted to Rs.11,000, and the cost of litigation.

Post-operative care

The opposite party (OP), in his counter, said the circumcision surgery was successful but the consumer failed to follow post-operative care though advised by him.

An advocate commissioner was appointed to examine the specialist doctor.

Cross examination

During the cross examination, it was established that the circumcision was partial and only due to that a second surgery had to be performed.

President of the Forum-I Y. Dhilleswara Rao and members G. Viswanatha Reddy and D. Suseela, in their recent verdict, held it was a case of medical negligence and consequent deficiency in service.

In the result, the OP was directed to pay Rs.10,000 towards treatment and other incidental expenses.

The Forum awarded Rs.50,000 as compensation for mental agony, hardship and inconvenience suffered by the consumer and a further Rs.10,000 towards cost of litigation.
