Consumer Commission’s directive to housing board

CHENNAI: The State Consumer Disputes Redress Commission has confirmed an order of a lower forum directing the Tamil Nadu Housing Board (TNHB) to pay a person Rs.10,000 towards deficiency in service and execute the sale deed for a house allotted to him by the Board without insisting on payment of extra cost.
The District Consumer Disputes Redress Forum, Chennai (South), had also directed payment of Rs.1,000 as costs.
Dismissing an appeal filed by the Board challenging the lower forum’s order, the Commission Bench, comprising its president Justice K. Sampath and member Pon. Gunasekaran, said if the land in question was not subject matter of acquisition proceedings, the department ought to have fixed the land cost and, if there was any escalation, demanded the same from the complainant, R. Muthukrishnan of Eswaran Nagar, Ramapuram.
“Unacceptable ground”
It should not have allowed matters to drift citing a totally unacceptable ground as the cause for delay in fixing the final cost.
The Bench said as pointed out by the complainant, while returning the difference in interest and other amounts, there was no whisper by the Board about any pending land acquisition proceedings and that the final cost would be worked out only after those land acquisition cases were disposed of.
“No merit”
The Bench held that the District Forum was right in granting relief to the complainant. It said it did not find any merit whatsoever in the appeal.
