Seizure ordered

BANGALORE: The Karnataka High Court on Monday took offence at the manner in which its interim order was flouted by a private transport operator and directed the State Government to seize his vehicle.
The court was dealing with an appeal by Singabathullah of Islamia Roadways of Kanakapura and Kalasipalyam, Bangalore, against a single judge’s order.
The Transport Department, on November 21, 2006, seized a bus belonging to the petitioner for non-payment of tax. A single judge dismissed the petition filed by the company.
The company then filed an appeal. A Division Bench, in an interim order, directed that the vehicle be released subject to the petitioner fulfilling certain conditions.
When the matter came up on Monday, the Government submitted that the petitioner had violated the terms of the interim order.
A Division Bench comprising Justice V. Gopala Gowda and Justice Arali Nagaraj directed the State to seize the vehicle and adjourned further hearing on the case.
