Kannur: State files appeal

Kochi: The State government and the Director-General of Police, on Tuesday, filed an appeal seeking to expunge a single judge’s observations on the recent political violence in Kannur district.

The appeal said the government was given no opportunity to present its views while the judge made those observations.

On the observation on the need for a “timely intervention by the Union government” in Kannur, the appeal said that no such issue had arisen in the case, and the view was expressed without relying on any material on record.

The appeal said the observation “pre-supposes” a complete breakdown of law and order in the State. Law and order was a State subject.

The observations went against the “Constitutional scheme of the government functioning” in the State, the appeal added.

CBI gets time

A Division Bench, comprising Chief Justice H.L. Dattu and Justice K.M. Joseph, granted the Central Bureau of Investigation (CBI) six months to complete the investigation into the SNC- Lavalin case and submit a report.

The Bench, while disposing of a petition filed by T.P. Nandakumar, Editor, Crime, said it was satisfied that sufficient progress had been made by the investigating agency in the case.

When the petition came up, S. Sreekumar, counsel for the CBI, submitted that the agency required nine months to complete the investigation. Counsel had produced a progress report in a sealed cover.

HMT deal

A Division Bench of the Kerala High Court, on Tuesday, orally directed the State government to produce before it the report on the HMT land deal given by a committee headed by the Chief Secretary as well as the legal opinion given by the Advocate-General. The Bench, comprising Chief Justice H.L. Dattu and Justice K.M. Joseph, asked the Advocate-General to make available the reports when the arguments on a writ petition seeking a CBI inquiry into the land deal resumed on Tuesday.

Notice issued

A Bench issued notice to the Union government and others on an appeal filed against a single judge’s verdict upholding the Centre’s notifications banning import of palm oil through the ports in the State.
