Suit against school dismissed
Staff Reporter
BANGALORE: Parents, teachers and schoolchildren of a Government Urdu Kannada primary school in Bangalore heaved a sigh of relief when the Karnataka High Court dismissed a suit against the school. The school was started by the Government in Nayandanahalli, Bangalore, in 1954. The land on which the school stood initially belonged to a private company. The company, through a resolution, handed over the land to the Government to enable it to start a school.
D. Muthayya, a moulder in the company, filed a suit in a lower court claiming ownership of the land. The lower court dismissed the suit. He filed an appeal in the High Court. Opposing the petition, the Government said the sale deed executed in Mr. Muthayya’s favour is null and void. Moreover, the suit instituted against the Government in this case, is flawed.
Justice S. Abdul Nazir dismissed the appeal.
