‘Patient care allowance applicable to CRPF staff’

A model employer like CRPF should extend benefit to all similarly situated persons: Delhi High Court

NEW DELHI: Imposing a cost of Rs.5,000 on the Central Reserve Police Force for not granting patient care allowance to all its Group C and D employees of Combat Hospital despite repeated court orders, the Delhi High Court has made it absolute and applicable to all the employees.

Petitions filed

A Division Bench of the Court comprising Justice A. K. Sikri and Justice J. M. Malik passed the direction on a bunch of petitions by some of the employees seeking directions to the CRPF to grant them the allowance.

“We make the rule absolute and allow the petitions with a direction to the CRPF and the Union Government to grant the allowance to the petitioners -- Group C and Group D employees of the hospital staff. We also direct them to extend this benefit to other similarly situated staff,” the Bench said.

CRPF pulled up

The Bench also pulled up the CRPF for not granting the benefit to all the Group C and D employees of the hospital staff on its own. The CRPF had accepted the entitlement of certain employees to the benefit only when they had obtained orders from the Court, the Bench noted.

The Court said a model employer like the CRPF should extend the benefit to all similarly situated persons.
