CHENNAI: The Tamil Nadu Outdoor Advertising Association has filed a writ petition in the Madras High Court seeking a writ prohibiting the authorities from interfering with hoardings erected by the association members for which applications were made before June 15, 2001, the cut-off date prescribed by the Supreme Court. The association, represented by its secretary A.G. Nayagam submitted that the Supreme Court passed the order in the hoardings case on April 9 and the association was informed about it at 12.15 p.m. the same day. The full contents of the order were not known to anyone, including the counsel in Delhi, in the city. Unfortunately, the authorities here started removing all hoardings, particularly the hoardings for which applications had been filed before the cut-off date and pending before the licensing authority, from 3 p.m. onwards. On April 10, the association members were simultaneously served with a bunch of orders dated the previous day stating that the applications for licences submitted by them had been rejected and the hoardings should be removed immediately. Many hoardings had been removed the previous night itself. The action of the authorities in removing the hoardings for which applications were pending as on April 9 was a clear violation of the Supreme Court’s order in a case. The authority had rejected the applications without considering the merits and demerits of each case. The First Bench comprising Chief Justice A.P. Shah and Justice Prabha Sridevan has adjourned the matter to April 22.
