Conviction upheld in Kathipara blast case

New Delhi: The Supreme Court has dismissed, at the admission stage, special leave petitions filed by two accused convicted and sentenced to undergo 10 and 2 years rigorous imprisonment respectively in the Kathipara bomb blast case of 1988, in which a statue of Jawaharlal Nehru was partially damaged.

A Bench of Justice Arijit Pasayat and Justice P. Sathasivam, after hearing counsel for the petitioners, said in a brief order: “No merits. The SLPS are dismissed.”

According to the prosecution, petitioners Pozhilan alias Mani (awarded 10-year imprisonment) and Egairasan (two-year imprisonment) along with 13 other members of the Ulaga Tamil Ina Munnetra Kazhagam, conspired to have a separate Tamil Nadu and planted bombs behind the Nehru statue at Kathipara in Chennai and the TV station at Kodaikanal, causing explosions. The trial court found them guilty and awarded life imprisonment to Pozhilan and various terms of imprisonment to the other accused. On appeals, the Madras High Court modified the sentence of life imprisonment to 10 years for Pozhilan and confirmed the two-year sentence on Egairasan. The present SLPs are directed against this judgment. They contended that the prosecution had not proved that they along with other accused had assembled in the office of UTIMK to hatch a criminal conspiracy and that they had prepared the explosives and participated in the conspiracy. They sought quashing of the impugned judgment dated September 7, 2007.
