New Delhi: The Supreme Court has directed the Tamil Nadu Public Service Commission and the Madras High court to notify the 201 vacancies in the cadre of civil judge, junior division and start the selection process by calling for applications. A Bench comprising Chief Justice K.G. Balakrishnan and Justice R.V. Raveendran gave this direction on a special leave petition filed by the TNPSC against a March 23, 2007 order passed by the High Court on a suo motu petition from its Registrar General that the High Court would set the question papers for the test, correct the answer papers and also select the candidates. The Bench in May last had stayed the order. The TNPSC questioned the decision contending that the High Court could not devise its own procedure to hold a written examination for filling the vacancies contrary to the rules issued by the State government in consultation with the High Court. Subsequently both the Commission and the High Court arrived at a settlement, according to which “the setting up of question papers with key answers by the High Court and evaluation of the answers by senior district judges to be nominated by the High Court were agreed upon. The request of the TNPSC for constitution of 5 Boards for the purpose of viva-voce and nomination of 5 High Court Judges in this regard was discussed. The Chief Justice (of the High Court) will nominate 5 Judges for viva-voce and to depute them (for half a day) for about two weeks for the said purpose.” The Bench in its order said “the notified vacancies as on September 30, 2007 were 181 and it is revised to 201 up to December 31, 2008 in view of the fact that the selection process as well as training will take more than six months. The Chairman as well as the Secretary of TNPSC have agreed to notify the 201 vacancies.”
