BANGALORE: The Karnataka High Court on Tuesday stayed an order of the Commissioner of Public Instruction withdrawing registration of a school located on Magadi Road in Bangalore. The petitioner, Kamalaa Naidu Educational Trust, said it was running the Surekha International School since 1999. It said some time ago, a brick from a building under construction fell on a student who died of head injuries. It said the Upalokayukta had taken suo motu notice of the incident and ordered an inquiry. The Upalokayukta had also appointed a special investigation officer to go into the incident. After the inquiry officer submitted his report, the Education Department authorities sought an explanation from the school and sent notices to it. The trust said it had replied to the notices and also prayed to the authorities to drop the proceedings against it. However, on April 17, 2008, the Director (Higher Education) and Registering Authority, office of the Commissioner of Public Instruction, issued a notice withdrawing the institution’s registration. The trust challenged the action saying that it had not been afforded an opportunity of hearing and that the notice sent to it was terse and did not contain any details. It urged the court to stay the notice. Justice Ravi Malimath, in his interim order, stayed the withdrawal of registration for six weeks and adjourned the case.
