BANGALORE: The Karnataka High Court on Friday stayed an amendment by the State Government relating to the transportation of minerals. Justice Ravi B. Malimath passed the order on petitions by Kumaraswamy Ores and six other companies. The petitioners had challenged the April 2008 notification by the State amending the rule relating to the transport of minerals. The amendment reduced the time to transport the minerals from one month to a week. Transporters were also required to obtain a permit every time they transported minerals or ore. Challenging the amendment, the petitioners said the High Court had earlier stayed the one-week rule and asked the State to revert back to the one-month period. They said the State had once again issued an order, ignoring the court’s earlier order. They urged the court to stay the April 2008 order, saying that it is illegal and illogical. On its part, the State contended that the amendment was carried out to prevent pilferage and other illegal activities. Justice Malimath ordered issue of notices to the State and other respondents and adjourned further hearing on the case. He also stayed the amendment to the rule reducing the time for transporting minerals from a month to a week.
