Decision upheld
Staff Reporter
NEW DELHI: The Delhi High Court has upheld a lower court judgment sentencing two persons to 10 years’ rigorous imprisonment in a case under the Narcotic Drugs and Psychotropic Substances Act.
Upholding the judgment, Justice S. Muralidhar said there was no infirmity in it.
The Special Cell of the Delhi Police had arrested the two accused, Mukund Prabhakar and Ramesh Kumar, near Palika Bazar in New Delhi allegedly while exchanging a 1 kg packet of smack in 2000.
The police said Mukund Prabhakar had brought the drug from Mumbai to sell it to Ramesh Kumar for Rs.1 lakh.
The Special Cell was tipped off that a man carrying drugs was travelling by a Mumbai-Delhi flight to deliver it to someone in Delhi. The Special Cell laid a tarp and arrested the two while allegedly exchanging the packet.
The lower court had sentenced the two in 2004. They had moved the High Court in an appeal challenging their conviction and sentencing.
