Court refuses to issue notice in Katara case

NEW DELHI: A court here on Monday refused to issue any notice to the prosecution in response to an application moved by the prime accused in the Nitish Katara murder case, Vikas Yadav. The application came in the wake of a sting operation carried out by a local daily seeking to establish that key prosecution witness Ajay Katara had lied in the court in favour of the victim.
Additional Sessions Judge Ravinder Kaur said let the matter come before the court on May 14 when the case is to come up for announcement of date for the verdict. With the final arguments in the case complete, the court had already fixed May 14 for finalising a date on which the verdict would have been pronounced.
In his application, Vikas sought summoning of witnesses, including the reporter who purportedly carried out the sting, under Section 311 (court’s power to summon witnesses) of the Criminal Procedure Code. Through his application, Vikas also wanted to bring on record the CD which allegedly contained the evidence against Ajay.
Moving another application in the court of District Judge Mamata Sehgal, another accused Sukhdev Pehalwan -- facing prosecution separately in the same case -- sought similar directions from the court.
