NEW DELHI: A court here on Tuesday transferred a plea by Sukhdev Pehalwan -- one of the accused in the Nitish Katara murder case who is facing trial separately -- for summoning of witnesses pertaining to a CD that allegedly contained damning evidence against key prosecution witness Ajay Katara to the court hearing the murder case. District and Sessions Judge Mamata Sehgal transferred the plea to the court of Additional Sessions Judge (ASJ) Ravinder Kaur who is hearing the murder case in which Vikas Yadav, son of former Member of Parliament, is the main accused. The court said since a similar application had been moved before the court of the ASJ, it would be appropriate for that particular court to hear the petitioner’s plea. The ASJ has posted the matter for hearing on Wednesday at 10 a.m. Earlier, on Monday, following a “sting operation” carried out by a local daily in which key witness Ajay allegedly admitted to having lied in court to favour the prosecution, Sukhdev had moved the court of the District and Sessions Judge seeking summoning of witnesses, including the reporter who apparently carried out the sting, and also bringing the CD on record. Vikas Yadav, too, had moved a similar application in the court of the ASJ. However, the ASJ had refused to issue any notice and said that the matter would be taken up on Wednesday when the case comes up for fixing of a date for pronouncement of verdict.
