Quota: High court orders notices

CHENNAI: The Madras High Court has ordered notices returnable in four weeks to the State government represented by the Department of Personnel and Administration and two others on a petition filed by S. Prem Manohar William, seeking to direct the government to implement its order dated 29 October, 2007, providing reservation to Backward Class Christians for recruitment in the Group I Services for the year 2006-07 for certain posts.

The petitioner, a resident of Saidapet, contended that the date of notification for the Group I services was August 1, 2007, and the last date for receipt of applications by the Controller of Examinations of the Tamil Nadu Public Service Commission, the third respondent, was August 31, 2007.

In the said notification it was stated that the selection would be made in three successive stages, preliminary examinations for selection of candidates for admission to the main written examination, a main written examination to be followed by an oral test in the form of an interview. In the notification, it was also stated that the preliminary examination was meant to serve as a screening test only and the marks obtained in it would not be counted for determining the final order of merit of candidates qualified for the main written exam, he said.

The G.O. on reservation stated that the 200 point roster shall be given effect from September 15, 2007 and the vacancies arising on and from that date shall be filled as per the roster and all selections for appointment shall be started afresh from serial number one of the roster with effect on and from the said date. The G.O., giving effect to the vacancies arising on September 15, 2007, should not be separately taken out and could not be viewed that the vacancies as on the date of notification, that is on August 1, 2007, was not applicable. Since the selection processes pertaining to the Group I Services have only begun after the date of the G.O. The Preliminary Examination was held on December 23, 2007.

He prayed the court to admit him for the main written exam for the said Group I Services to be conducted in the near future. Justice M. Sathyanarayanan ordered notice to the Government returnable in four weeks.
