Do not spare illegal constructions, says consumer body

Identify buildings on public purpose sites, Corpn. told

COIMBATORE: The Coimbatore Consumer Cause, a consumer welfare organisation, has called upon the Coimbatore Corporation not to spare any unauthorised construction in the city.

In a letter to Corporation Commissioner V.K. Shanmugham, the consumer body’s secretary, K. Kathirmathiyon, has said that the civic body should demolish such structures and that it should not continue to claim that it did not have the powers to do so. A recent judgment of the Madras High Court had pointed out that the Corporation could undertake demolition under Section 296 (3) of the Coimbatore City Municipal Corporation Act.

Therefore, it was pointless to argue that the civic body was in no position to demolish the buildings.

Mr. Kathirmathiyon pointed out that in the recent judgment, the High Court had dismissed a writ filed against the Corporation in respect of action initiated by it against an unauthorised construction on a reserved site in the city. Passing an order on the writ filed against the demolition notice, the court held that the construction was totally in violation of the statutory provisions and the Corporation Act. The consumer body hoped that the Corporation would remove the unauthorised structure since the court had upheld it demolition order.

“In this connection, we wish to state that the courts have repeatedly held that no construction should be allowed on public purpose sites. But we understand that many unauthorised constructions were illegally permitted. Please arrange to identify those buildings and take appropriate action immediately,” Mr. Kathirmathiyon said in the letter.

Further the Corporation used to claim that it did not have any powers to demolish the unauthorised construction and only the Local Planning Authority was vested with the powers. “But we have repeatedly disputed the claim and pointed out that Corporation could take action under Section 296(3) of the Coimbatore City Municipal Corporation Act. In the recent judgment, the court had upheld the powers of the Corporation under Section 296(3). We hope that the Corporation will take action under this Section at least against unsafe and unauthorised public buildings (where people gather in large numbers, such as shopping complexes).”
