Notice to Fashion Design Council

NEW DELHI: The Delhi High Court has issued notice to the Fashion Design Council of India, a non-profit making society of fashion designers, on a suit by two members of the voluntary organisation challenging the appointment of a person to the post of Executive Director on the ground that it amounted to duplication.

Issuing the notice, Justice Reva Khetrapal of the Court asked the respondents to file a reply to the petition by July 7, the next date of hearing.

The petitioners, Karuna Khaitan and Anju Mody, members of the organisation, through their counsel Inderpreet Singh Josh submitted that the appointment of Sumit Nayar to the post was illegal as another person was already holding it.

They submitted that while incumbent Executive Director was drawing a salary of Rs. 2 lakh per month, Mr. Nayar was appointed to the post on a salary of Rs. 3 lakh per month.

The terms and conditions on which Mr. Nayar had been appointed were one-sided. While the post is of permanent nature he had been appointed as a consultant, the petitioner submitted.

The petitioners urged the Court to declare the appointment of Mr. Nayar to the post null and void and direct him to deposit the salary he has drawn thus far to the organisation.
