CHENNAI: The Madras High Court has said the Vice-Chairman of the Rajapalayam Municipality is at liberty to give a reply to a notice issued to the municipality by the government to show cause why the local body council should not be dissolved. Passing interim orders on a writ petition filed by the municipality Vice-Chairman, S.A. Manikandaraja, Justice K. Venkataraman said the Secretary of the Municipal Administration and Water Supply Department (MAWS), which issued the notice, is at liberty to pass orders on the reply; but the orders should be kept in abeyance for two weeks to enable the petitioner to work out his remedies. In his petition, filed by counsel P.H. Manoj Pandian, Mr. Manikandaraja belonging to the AIADMK submitted that the municipality Chairman, Rathinam, did not have a majority in the council and was afraid that the resolutions proposed by her would be defeated. She failed to conduct meetings of the council for several months. The failure of the municipality Commissioner and the Chairman to conduct municipality meetings was brought to the knowledge of the Secretary, MAWS, Commissioner of Municipal Administration, Regional Director of Municipal Administration and the Virudhunagar District Collector. MLA writes to authoritiesThe Rajapalayam MLA had also written to the authorities that as the municipal council meetings were not being held, the public suffered; but the controlling authority had not directed the municipality Commissioner and the Chairman to perform their legal obligations till date.
