High Court directive to DDA

NEW DELHI: The Delhi High Court has directed the Delhi Development Authority to allot an LIG (Low Income Group) flat to a woman applicant at the rate at which she had booked it 17 years ago.

Directing the DDA to allot the flat to Bina Gandhi, Justice Kailash Gambhir also imposed costs of Rs.25,000 on it and asked it to pay the amount to the allottee in compensation for mental harassment to which she was subjected.

Bina Gandhi had booked the flat for Rs.1.64 lakh in 1991. She paid Rs.56,000 to the DDA at the time of booking and agreed to pay the remainder in equal monthly instalments of Rs.1,424. The DDA allotted the flat to her at Rohini in West Delhi in 1994. However, when she went to take possession of it, the junior engineer of the zone told her that the flat had been allotted to another person who had already taken possession.

The DDA later reinstated the flat to her when she complained about its transfer to another person. But the DDA at the same time increased the total amount to be paid by her from Rs.1.64 lakh to Rs.2.89 lakh. Having exhausted all non-judicial avenues for redress of her grievances, Ms. Gandhi approached the High Court for allotment of the flat at the rate at which she had booked it.
