Marital dispute settled

Court asks man to pay Rs.9 lakh to wife

NEW DELHI: A court here has allowed a man accused of criminal breach of trust and subjecting his wife to cruelty to settle his matrimonial dispute by paying Rs.9 lakh to the woman with whom his marriage has been annulled.

Additional Sessions Judge Kamini Lau directed Tariq Durrani to pay his wife the amount to settle the dispute and also granted him protection against arrest. The court observed that Durrani and his divorced wife, Sazia Mehfoz, had agreed to the settlement voluntarily, without any force, fear and coercion.

However, the court warned Durrani, who was in jail and seeking bail, that non-fulfilment of conditions would render the compromise invalid.

On the other hand, the court directed the woman to vacate the matrimonial house. The court has set June 9 for the couple to submit a compliance report.

The decision came after Ms. Mehfoz and Durrani submitted that their marriage had been annulled by pronouncement of “talaaq”. They have also withdrawn other civil and criminal cases against each other.

In arriving at the decision, the court took the assistance of the Delhi Legal Services Authority through its Secretary and Metropolitan Magistrate Guatam Manan.

Earlier, Ms. Mehfoz had got a case registered under Sections 406 (criminal breach of trust) and 498-A (husband or relative of husband subjecting a woman to cruelty) of the Indian Penal Code at the Malviya Nagar police station in South Delhi.
