CHENNAI: The Principal Sessions Judge (PSJ), Chennai, on Friday dismissed the bail plea of the two accused in the Kelly Baker case. PSJ Aruna Jagadeesan said considering the facts and circumstances of the case, gravity of the offence and the pending result of the medical test conducted on the complainant and the accused, it was not possible to grant bail for the petitioners. Jose Mathew of Shenoy Nagar and Saji John of Villivakkam stated in their petition that the allegation against them was false. No offence had been made out. The Teynampet police had registered a case against the two for an alleged offence under sections 323 (punishment for voluntarily causing hurt), 324 (voluntarily causing hurt by dangerous weapons or means), 354 (assault or criminal force to woman with intent to outrage her modesty) and 379 (punishment for theft) IPC on a complaint from Kelly Baker, an American. According to the police, Ms. Baker went with a friend to a bar in a star hotel on TTK Road on the night of May 24. She consumed four glasses of alcohol and had waited for the bar to clear out before leaving it. She does not remember what happened after that. All she could recollect was that she found herself in a car with two men who told her that they had found her on a pavement in Anna Nagar. After she was dropped at home she found that she had scratches and feared she had been molested. She went to a private hospital and underwent medical examination. Doctors told her that she had not been molested. On May 28, she lodged a complaint with the Teynampet police stating she had lost some of her belongings, including her mobile phone and camera. In her complaint, she stated that she remembered the name of one of the men who was Jose. Following this, Jose Mathew and Saji John were arrested and remanded to judicial custody.
