Supreme Court notice to Delhi Govt. on regularisation of unauthorised colonies

“Notification issued without providing any infrastructure for these colonies”

Bench will take up the matter on July 7 when validity of the Master Plan would be examined


NEW DELHI: The Supreme Court on Thursday asked the Delhi Government to respond to complaints that its notification for regularisation of 1,400 unauthorised colonies across the Capital had been issued without providing any infrastructure for these colonies.

A Vacation Bench of Justice Arijit Pasayat and Justice G. S. Singhvi directed the Delhi Government to file an affidavit in the Court before July 7.

The Bench said it would take up the matter on July 7 when the validity of the Master Plan for Delhi-2021 would be examined.

Earlier, amicus curiae and senior counsel Ranjit Kumar made a mention before the Bench that the Union Urban Development Ministry and the Delhi Government had issued a notification three days ago for regularisation of the 1,400-odd unauthorised colonies across the Capital.

He alleged that the Delhi Government had resorted to the hasty action of regularising the colonies without making a provision for adequate infrastructural facilities.

He said the Supreme Court was already examining the issue of availability of infrastructure to meet the requirements of the Master Plan for Delhi-2021.

The Court, he added, had stated earlier that it would give its approval for the Master Plan only if the Government was in a position to provide the requisite infrastructure.

He said when the Government was not in a position to meet the infrastructure requirements of the Master Plan, then how was it possible to create additional facilities for the 1,400 unauthorised colonies.

Agreeing with his submissions, the Bench directed the Delhi Government’s counsel to file an affidavit on the issue and said Solicitor-General G. E. Vahanvati would render assistance to the Court on the issue.
