Plea against conviction

CHENNAI: The Madras High Court on Thursday admitted a criminal appeal filed by a person against his conviction and sentencing by the Additional Special Court for CBI cases, Chennai, in fake stamp paper scam case in January this year.
In the appeal, C.S.Balaji of Thirumangalam in Annanagar West, who is lodged in the Central Prison, Bangalore, said when the charges were framed against him in August 2007, he had pleaded not guilty. Thereafter, CBI officials told him that if he pleaded guilty, he would be let off with a sentence of set off against the remand period. He agreed to the offer and pleaded guilty when the court questioned him again.
He contended that the Judge ought not to have sentenced him to five years and a total fine of Rs.2 crore. The judgment was against law, weight of evidence and probabilities of the case. The trial court exercised its discretion whimsically and arbitrarily. The court did not give any cogent reason for imposing an exorbitant and harsh fine of Rs.2 crore.
When the matter came up before Justice T. Sudanthiram, Special Public Prosecutor (SPP) N.Chandrasekharan took notice.
In the order, the Judge said since the accused had already pleaded guilty and it was now being challenged, counsel for the petitioner and the SPP had agreed for posting the matter for final hearing after two weeks.
