‘Stop work’ orders withdrawn, court told

Special Correspondent

‘Government decision on special economic zones

has rendered petition redundant’

PANAJI: The Goa Government on Wednesday informed the Bombay High Court in Goa that it has withdrawn the “stop work” orders issued by it, in favour of notified Special Economic Zones (SEZs).

This was stated by Goa Government’s advocate in the High Court on Wednesday during a hearing of cases filed by K. Raheja Corporation and Meditab, promoters of two of the notified SEZs, challenging the government order dated January 10, 2008.

Earlier, advocate for the petitioners argued before the court that following the Centre’s orders dated May 21, expressing its inability to de-notify the already notified SEZs, the State Government had no powers to issue such orders.

When the court asked the Government to clarify its stand, it was informed about the decision to withdraw the “stop work” orders, which the government pleaded had rendered the petition redundant.

The controversy over the SEZ projects took yet another interesting turn on Wednesday following a petition filed by K. Raheja Corporation in the Bombay High Court at Goa which sought to challenge the show cause notice issued by Goa Industrial Development Corporation on June 13.

Petition

The petition seeks to challenge the jurisdiction of the authority, as also claims violation of its rights under Article 14 of the Constitution. The petitioner sought an interim relief pending hearing. The court , however, ordered that status quo be maintained, and stated that if the petitioner carried on construction work, it would be at hsi own risk.

The court has fixed the next hearing on July 18.
