High Court dismisses Anil Nanda’s suit

NEW DELHI: The Delhi High Court on Thursday dismissed a suit by Anil Nanda challenging the decision of the governing body of Delhi-based Escorts Heart Institute & Research Centre Limited (EHIRCL) to convert it from a charitable society into a company.

Anil Nanda is the younger brother of Rajan Nanda, erstwhile Chairman of EHIRCL. He had sought restoration of the Institute to his original status of a charitable trust.

Dismissing the suit, Justice B.D. Ahmed of the Court said the plaintiff had not sought permission of the Court before filing the suit as provided in the Civil Procedure Code.

Anil Nanda had argued that EHIRCL was a charitable trust established by H.P. Nanda, father of Rajan and Anil Nanda, in 1981 and the Delhi Development Authority had provided it two acres of land at the rate of Rs.10,000 per acre. However, after the death of H.P. Nanda in 1999, Rajan Nanda and others of the Institute had allegedly hatched a conspiracy to grab its huge reserves and substantial assets by setting up another society with an identical name in Chandigarh.

Amalgamated

EHIRCL-Chandigarh was run for a few months and thereafter EHIRCL-Delhi and EHIRCL-Chandigarh were amalgamated and later it was converted into a company, he had submitted.
