Court asks Government to file objections to Reebok petition

Department of Legal Metrology has seized Reebok products


BANGALORE: The Karnataka High Court has asked the State Government to file its objections to a petition by Reebok India challenging a notice issued to it under the Standard Weights and Measures Act.

Reebok, in its petition, said it has its registered office in Bijwasa, New Delhi, and branches all over India. It said it is engaged in business of import, marketing, sale and supply of sports goods, footwear, apparels and accessories.

It said the office of the Department of Legal Metrology, Belgaum, issued notices to its showroom in Belgaum for alleged offences under the Standard Weights and Measures (Packaging Commodities) Rules 1977.

It said some of its products were seized for violating Section 39/63 of the Act.

Reebok said the Act applies only to the goods falling under Section (3) (d) of the Act and that they apply to commodities sold by weight, measures or numbers in packed form.

It said its products are sold under the criteria of specification, features, configuration and design. Moreover, these products are not sold in packaged form.

Though these products arrive in the showroom packed, they are displayed and then bought by the consumer.

Reebok said its products are similar to that of cars. Just as cars cannot be packed, their products too cannot be packed.

Both are displayed in the showroom, it said and urged the court to stay the notices and also direct the authorities concerned to release the seized goods.

Justice K. Bhaktavatsala adjourned the petition and asked the State to file its objections.
