Udupi Math moves court

BANGALORE: One of the eight Asta Maths of Udupi on Thursday petitioned the Karnataka High Court against what it claimed is threatening notices by the Udupi tahsildar to take over the lands belonging to the math.

Krishnapur Math, in its petition, said it is one of the eight maths established centuries ago by Madhwa saint Madhvacharya. It said for centuries the main income for the maths came from the lands it owns.

It said when the Karnataka Land Reforms Act was amended, it filed a declaration (detailing the lands and survey numbers it owned) under Section 66 of the Act. In 1972, the Udupi Land Reference Tribunal passed an order stating that the math had power to hold the lands it had declared.

On May 8, 2007, it said the Udupi tahsildar issued a notice asking why penalty should not be imposed on the math under Section 79 of the Act and why possession of the land should not be taken over by the Government. When the math replied saying that the Land Tribunal had passed orders permitting it to retain the lands, the tahsildar sought copies of the order and other related documents.

When the math refused to furnish the documents, the tahsildar began regularly sending notices to it, saying that its lands would be taken over. It said the last such notice came to be sent on February 16, 2008.

It urged the court to stay the notices and all actions subsequent to it.

Justice Huluvadi G. Ramesh asked the Government to procure the records and also keep the tahsildar present during the next date of hearing.

Quashed

Justice Huluvadi G. Ramesh on Thursday quashed an order of the Education Department withdrawing recognition to a private school in Bangalore.

The Block Education Officer (BEO) had passed orders withdrawing recognition after an investigating officer appointed by the Upa Lokayutka had given a report citing several irregularities in the school. Justice Huluvadi G. Ramesh noted that the orders passed by the BEO were technically wrong. He asked the BEO to decide the issue after giving an opportunity to the school and other parties.
