Court issues notice to Congress leader

CUTTACK: The Cuttack Sadar SDJM court on Friday issued notice to former Union Minister and senior Congress leader K.C. Lenka to file counters in response to a petition filed by the Cuttack district administration in connection with Lenka’s false affidavit case.

The SDJM while adjudicating on the petition which prays for condoning the delay in filing the case against Lenka, has issued notice to the Congress leader to file his reply.

On the basis of a complaint filed by Harihar Parida, a native of Choudwar Assembly constituency and subsequent orders from State chief electoral officer, the constituency returning officer had filed the case against Lenka. The Congress leader who lost the 2004 Assembly elections was charged with suppressing facts about his property, pending vigilance cases and educational qualification in the mandatory affidavit that every candidate was required to submit at the time of filing nomination papers. Since the case was filed in June this year even as the elections were complete in April 2004, the district administration had urged the court to condone the delay in view of the long process of investigation after getting the complaint. The court after hearing both the parties would decide whether to take cognizance of the main petition.

Meanwhile, the lower court on Friday also rejected the petition filed by Parida, who was projected as the complainant against Lenka. Parida, in his petition had denied of having made any complaint against Lenka.

A former student leader and now a Congress activist of Choudwar, Parida said that his signature had been forged in the original complaint with a motive to damage his relationship with Lenka. Urging the court to direct a probe into the forgery, he had alleged that even after his denial, the district administration, state CEO and the EC had gone ahead to file the case against Lenka “with an ulterior motive”.
