Warrant against BBMP Commissioner recalled

BANGALORE: The Karnataka High Court on Friday recalled a bailable warrant against the Commissioner of Bruhut Bangalore Mahanagara Palike (BBMP).

The court had issued the warrant after a complaint was filed that the BBMP had not followed the reservation norms while appointing employees. The BBMP filed a memo urging the court to withdraw the warrant. A Division Bench led by Justice V. G. Sabhahit recalled the warrant.

Show cause

A Division Bench comprising Justice V.G. Sabhahit and Justice Jawed Rahim on Friday ordered issue of a show cause notice to the Director and Inspector-General (DG and IG) of Police for failing to comply with the court orders to file a report on missing persons.

The Bench said when it was dealing with a petition by Mohammad Ghouse, seeking a direction to the police to trace his missing daughter, it had asked the police to furnish a report. It said the High Court Registry had sent several reminders to the Police Department, but to no avail. It directed issue of show cause notice to the DG and IG of Police as to why action should not be taken for non-compliance of May 30, 2008 order.

Poignant scenes

Poignant scenes were witnessed at the court when a three-year-old girl, being looked after by her grandparents, was handed over to her father. A Division Bench led by Justice K. Sreedhar Rao was dealing with a habeas corpus petition by the father of the child seeking its custody.

The Bench directed the grandparents to appear in court along with their granddaughter and noted that as per the law, a mother would get first right over a child. However, in this case as the child’s mother was not alive, the father would be the guardian. The grandparents broke down outside the court hall when the child was handed over to their son-in-law.

Notice to Kumta MLA

The court ordered issue of notices to Dinakar Keshava Shetty, Kumta MLA, and others following an election petition by Congress candidate Mohan Krishna Shetty.

In his petition, Mr. Krishna Shetty said he had obtained 30,772 votes against 30,972 polled by Mr. Keshava Shetty in the election held in the State on May 16, 2008. He said he would have won the seat had the Returning Officer counted the ballots properly.

He claimed that one of the ballot boxes was broke open as the key was lost. When the box was opened, election agents crowded around it and this resulted in confusion.

He urged the court to countermand the election and order recounting of votes.
